Why sue debt collectors? Why sue any one for that matter?  Some people may say, “your client incurred the debt in the first place, so it’s his fault for being harassed by debt collectors”.  We sometimes hear this sentiment when discussing the Fair Debt Collection Practices Act (FDCPA) with people who have never been victimized by a debt collector’s harassing conduct.  However, what these people don’t realize is that the laws governing debt collection practices were enacted by Congress to promote four principles:

1) Truth,
2) Fairness,
3) Dignity, and
4) Respect.

No one wants to go into debt.  Virtually every debt is incurred because of economic hardship, whether caused by excessive and unplanned-for interest fees, loss of employment, inability to find a job in a tough economy, serious injury or illness, or simply having to prioritize tight funds to maintain food and shelter for one’s family.  Everyone deserves to be treated with fairness, dignity, and respect, and to be free from dishonesty and trickery—if for no other reason than to simply empathize with their unfortunate circumstances.

When debt collectors fail to treat people with these principles in mind, they are generally violating the laws that govern how they can operate their collection activities.  Before these laws were passed, debt collectors were going to the extremes of threatening people with violence, falsely warning people they are committing crimes, publishing lists of “dead beats” naming people to the public who have incurred debt, and many other extremely disgusting conduct all because the people unexpectedly fell under harsh times and found themselves unable to pay a debt that they had originally planned to incur.

When debt collectors treat people with unfairness, indignity, disrespect, or dishonesty, they are undermining the integrity of our society and economy.  Congress enacted the right to sue for very important reasons; do not let the debt collectors get away with it.  Enforcing these laws will eventually make them comply, and will in turn make them treat everyone with:

1) Truth,
2) Fairness,
3) Dignity, and
4) Respect.

Why sue debt collectors? You deserve it, as does everyone else.
