Are you receiving multiple automated phone calls and you want them to stop?  Are you receiving calls on both your cell phone and home phone?  You may be entitled to monetary relief and a court order for the calls to STOP!

In the Telephone Consumer Protection Act (TCPA) the U.S. Legislature prohibits certain methods of calling.  This Act applies to everyone calling someone within the U.S.; these prohibitions do not just apply to debt collectors or original creditors.

  1. Do receive calls over and over and over and over, even if you had already answered one of the earlier calls?

The caller is most likely using a robo-dialer, also known as an automatic telephone dialing system to make automated phone calls.  Simply put, a list of phone numbers is entered into a computer system that repeatedly calls every number on the list over and over and over, and does not recognize if the recipient has already answered one of the earlier calls.  Some people have received thousands of calls from a robo-dialer over a period of months!!!  Unless you have given your consent to receive calls from a robo-dialer or unless the call is for emergency purposes, the use of a robo-dialer to call a cell phone or any other line for which the recipient is charged for the call is absolutely ILLEGAL.

 

  1. Do you receive calls that have a delay when you answer before a live person responds?  After the live person responds, do they ask for your name?  Does it sound as if they don’t even know who they called?

Then the caller is most likely using a robo-dialer to make these automated phone calls.  A live person is sitting in front of a computer screen with a headset connected to the phone line that the robo-dialer has called.  Once the connection is made upon you answering the phone, the live person will be connected and your name and information will pop up on the computer screen so that the live person can see the name and number of the person called (and possibly other personal information as well).  Again, unless you have given your consent to receive calls from a robo-dialer or unless the call is for emergency purposes, the use of a robo-dialer to call a cell phone or any other line for which the recipient is charged per call is absolutely ILLEGAL.

 

  1. Do you receive calls where no live person is on the other end at all and you only receive a recording upon answering?

Then the caller is using what is called a “pre-recorded or artificial voice message”.  A company creates a voice message to be sent to anyone who answers the phone, whether it is a person or answering machine who takes the call, and this method of contact is usually combined with a robo-dialing system as discussed above.  Unless you have given your consent to receive these artificial voice messages, or unless the artificial voice message is being sent for emergency purposes, it is absolutely ILLEGAL to use an artificial voice message when calling any phone line.

If you think you fall into any of the above categories, you may be entitled to monetary relief and a court order for the calls to STOP!!!  The TCPA authorizes anyone receiving such calls to file a lawsuit against the caller(s), and entitles you to $500-$1500 per call!

Moreover, if the calls are coming from a debt collection agency or a creditor claiming you owe them a debt, the calls may also violate State and Federal laws pertaining to fair debt collection practices, which may entitle you to additional monetary relief.
